This End User License Agreement is a binding agreement between you (the "Licensee") and A.C.E., Inc., d.b.a, ConfirmBuyer.com.

This license agreement governs your use of ConfirmBuyer.com applications and platform (the "Software") and related services. By installing or using the application / platform, you accept the terms of this agreement and consent to be bound by its conditions, including any updates or modifications made by ConfirmBuyer.com.

Patented Applications and Platform: As of 10/11/2024, all provisional patent information was submitted to the corporate attorney who is tasked with filing for and acquiring a patent for systems and methods outlined within our provisional patents. All intellectual property is owned by A.C.E., Inc. and is actively monitored and strictly enforced.

License Grant: The application is free to real estate buyers and sold to select real estate buyer’s . ConfirmBuyer.com grants you a non-exclusive, non-transferable, revocable license to use the application / platform on devices you own or control.

Restrictions: You may not copy, modify, reverse-engineer, or share the application with third parties. You must use the application only for lawful purposes.

Updates: ConfirmBuyer.com may provide updates that modify or remove features. You must install updates to ensure the application works correctly.

Data and Privacy: Your use of the application is subject to ConfirmBuyer.com's privacy policy, and location data may be collected and used in accordance with this policy.

Termination: This agreement terminates if you violate its terms, and you must stop using the application and delete it from your device upon termination.

Limitations of Liability: ConfirmBuyer.com is not liable for any damages arising from your use of the application, including data loss or service interruptions.

Jurisdiction: This agreement is governed by the laws of Florida.

Dispute Resolution: Any disputes will be resolved through binding arbitration in Pam Beach County, Florida, and class actions are not permitted.

Account Registration and Responsibility

Users must register for an account to access certain features of the platform. You maintain the confidentiality of your account credentials and for all activities that occur under your account. Immediate notification of any unauthorized use is required.

User Conduct and Responsibilities

You agree to use the platform for lawful purposes only and to provide accurate, current, and complete information when using the platform. You are prohibited from engaging in any activity that is fraudulent, harmful, or in violation of any applicable laws or regulations, including but not limited to unauthorized access to the platform, transmitting malware, or engaging in harassment. Under no circumstances is any user to share an account with anyone. Account sharing is prohibited and grounds for immediate suspension.

Data Privacy and Security

We prioritize your privacy and data security. All user data and documents are encrypted and stored securely in compliance with relevant data protection laws, including GDPR and CCPA. By using the platform, you agree to our Privacy Policy, which details how we collect, use, and protect your personal and buyer's information.

Compliance with Legal Requirements

This includes ensuring that all buyer's agreements generated through the platform meet legal standards and that you adhere to the recent mandate requiring written buyer's agreements before property tours.

Intellectual Property

All content, features, and functionality on this platform are the exclusive property of the developer and are protected by several pending patents, copyrights, trademarks, and other intellectual property laws. You are granted a limited, non-exclusive license to use the platform for its intended purposes. Unauthorized use of the platform’s content or software is prohibited.

Limitation of Liability

The platform is provided "as is," without warranties of any kind, either express or implied. The developer shall not be liable for any damages arising from your use or inability to use the platform, including direct, indirect, incidental, or consequential damages.

Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association and within Palm Beach County, Florida, and the prevailing party will be entitled to recover reasonable attorney’s fees and costs.

Governing Law

These terms are governed by the laws of the state of Florida. Any legal action or proceeding related to your use of the platform shall be brought exclusively in the courts of Florida.

Modifications to Terms

We reserve the right to modify these terms at any time. Users will be notified of any significant changes via email or through the platform’s notification system. Continued use of the platform after changes are made constitutes acceptance of the updatedterms.

They must comply with all relevant local, state, and federal laws and mandates, including but not limited to those governing real estate buyer's transactions, data privacy, document submittal, and electronic date and time stamping.

Developer Responsibilities

As the platform developer, we are responsible for maintaining the software’s functionality, security, system, and compliance with applicable policies, laws, and regulations. This includes regular updates to ensure the platform meets evolving legal standards, protecting user data and documents through encryption and secure storage methods, and providing support for users seeking assistance.

Data Privacy and Security

The platform adheres to stringent data privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), among others. All user data, including buyer's agreements, must be encrypted both at rest and in transit. The developer implements robust security measures to prevent unauthorized access, data breaches, and cyberattacks.
